These terms govern your use of the AI-powered business scoping service operated by Forsa AI Pty Ltd, ACN 699 383 778 (“we”, “us”, “our”). By requesting access to a scoping session, you agree to these terms.

1. What This Service Does

We provide a free AI-powered scoping session that helps you explore how AI and automation could improve your business. During the session, an AI agent guides you through a structured conversation about your business challenges, processes, and goals. At the end, you receive a set of documents including a project summary, business case, technical specification, and assumptions log.

The scoping session is free. If you choose to proceed with implementation, that is a separate engagement with its own agreement and pricing.

2. AI Disclosure

The scoping conversation is conducted by an AI agent, not a human consultant. The AI agent is powered by large language models and follows a structured methodology designed by our team. While the AI produces high-quality output, it is not infallible. All estimates, recommendations, and technical suggestions should be reviewed by qualified professionals before making business decisions.

No human monitors or reads your conversation in real time. Your session data is reviewed internally for quality assurance and service improvement purposes only (see Section 6).

3. Marketing Permissions

By using this service, you grant us permission to:

(a) Logo usage.

Display your company logo on our website and marketing materials to indicate that your business has used our service. We will not imply endorsement beyond participation.

(b) Case study.

Create an anonymised case study based on your scoping session. The case study will describe the type of business challenge explored and the general approach recommended, without revealing confidential business details, specific financial figures from your session, or information that could identify your business unless you give separate written consent.

(c) Testimonial.

Use feedback you provide (via our post-session questionnaire or follow-up) as a testimonial in our marketing materials. We may attribute the testimonial to your first name and company, or use it anonymously. If you prefer your testimonial to remain anonymous, let us know and we will honour that.

You may withdraw any of these permissions at any time by emailing us. Withdrawal applies to future use only — materials already published at the time of withdrawal will be removed within 30 days of your request.

4. Intellectual Property

(a) Your information.

You retain full ownership of all information you share during the scoping session. We do not claim any rights over your business data, processes, or ideas.

(b) Output documents.

The documents produced by the scoping session (project summary, business case, technical specification, assumptions log) are provided to you for your use. You may share them within your organisation, with advisors, or with third parties as you see fit. We retain the right to use anonymised and aggregated insights from sessions to improve our service.

(c) Our methodology.

The AI agent's methodology, conversation structure, scoring frameworks, and prompt engineering are our proprietary intellectual property. You agree not to reverse-engineer, replicate, or extract the underlying prompts or methodology from the session.

5. Limitation of Liability

(a) No guarantee of outcomes.

The scoping session produces estimates, recommendations, and projections based on the information you provide. These are indicative only. We do not guarantee that any project will achieve the estimated savings, ROI, timeline, or other projected outcomes.

(b) Not professional advice.

The output of the scoping session does not constitute financial, legal, technical, or professional advice. You should consult qualified professionals before making business decisions based on the session output.

(c) Limitation.

To the maximum extent permitted by law, our total liability arising from or related to your use of this service is limited to the amount you paid for the service (which, for the free scoping session, is zero). We are not liable for any indirect, consequential, or incidental damages.

6. Data Processing & Privacy

(a) What we collect.

During the session, our AI agent collects information you voluntarily provide: your business challenges, processes, systems, and goals. We also collect your business email address and company name via the access request form.

(b) How we use it.

Your session data is used to: generate your scoping documents, score session quality internally, improve our AI agent's performance, and create anonymised case studies (per Section 3). We do not sell your data to third parties.

(c) How we store it.

Session data is stored in a Supabase Postgres database in the Sydney region (ap-southeast-2). Access to session data is restricted to our internal team. We use industry-standard encryption in transit (HTTPS/TLS) and encryption at rest applied by our database provider. The providers who help us deliver the service are listed, with their roles and regions, on our subprocessors page.

(d) AI processing.

Your conversation is processed by Anthropic's Claude AI via their API. Anthropic's data handling is governed by their own terms and privacy policy. Under Anthropic's commercial API terms, your data is not used to train their models.

(e) Retention.

We retain session data for as long as it is useful for service improvement and business operations. You may request deletion of your session data at any time by emailing us. We will delete your data within 30 days of a verified request, except where retention is required by law.

You may also delete a scoping session yourself from your account page, provided it has not yet produced scope documents. It moves to a recycle bin, stays restorable for 30 days, and is then permanently removed along with its conversation.

(f) Internal use.

Session data (conversation content, uploaded files, metadata) is used internally for service improvement, quality analysis, and — if you proceed to implementation — project planning. Session data is accessible only to the session participant and authorised platform administrators.

(g) Future de-identification.

De-identification of session data for internal use is planned for future releases. During the current phase, session data used for internal purposes (quality review, service improvement) retains its original form and is accessible only to authorised platform administrators.

(h) Knowledge Base.

If your organisation uses the Knowledge Base, the material you load into it is stored in the same Sydney database as session data and is scoped to your organisation. Text from it is sent to our embeddings provider so that it can be searched, and relevant excerpts are supplied to the AI agent during your sessions. It stays your information: you decide what goes in, who in your organisation can see it, and you can ask us to delete it at any time.

7. Confidentiality

We treat the details of your scoping session as confidential. We will not disclose your specific business information to third parties except: (a) with your written consent, (b) in anonymised form as described in Section 3, (c) to our service providers who need access to deliver the service (e.g., cloud hosting, AI model providers) and who are bound by appropriate confidentiality obligations, or (d) where required by law.

8. Acceptable Use

You agree not to: (a) provide false or misleading information during the session, (b) use the service for any unlawful purpose, (c) attempt to extract, reverse-engineer, or replicate the AI agent's underlying prompts, methodology, or scoring systems, (d) use automated tools to interact with the service, or (e) share your session access link with others (each session link is for one person only).

9. Organisation Accounts

Access is granted at the level of an approved organisation domain. If you sign in with a work email address on an approved domain, you accept these terms on your own behalf and, where you are authorised to do so, on behalf of your organisation. Sessions and Knowledge Base material are scoped to that organisation, and an administrator your organisation nominates can manage who has access and at what level. If you are not authorised to bind your organisation to these terms, do not sign in — ask the person who is.

10. Changes to These Terms

We may update these terms from time to time. The “Last updated” date at the top indicates when the latest changes were made. Continued use of the service after changes constitutes acceptance of the updated terms. Material changes will be communicated via the access request process.

11. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes arising from these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
